These Terms of Service (“Terms”) govern your access to and use of any software, websites, services, applications, or materials owned or operated by Fencetimator by LeadLegend Ltd (“Fencetimator,” “we,” “us,” or “our”), including the quoting tool, automation platform, web applications, CRM integrations, and related products (collectively, the “Services”).

By accessing or using the Services, you agree to these Terms. If you do not agree, you must discontinue use immediately.

1. Eligibility and Use

You must be at least 18 years of age and legally capable of entering into binding contracts to use the Services. By using the Services, you represent and warrant that:

• All information you provide is accurate
• You are using the Services for business purposes
• Your use complies with applicable laws and regulations

2. Description of Services

Fencetimator by LeadLegend Ltd provides software tools that help fence contractors:

• Generate real-time project estimates
• Automate proposals and follow-ups
• Integrate with CRM and marketing systems
• Manage customer communications and quoting workflows

We do not guarantee any particular business outcomes, lead generation, or revenue increase from use of the Services.

3. Account Registration

To access certain features, you may be required to register an account. You agree to:

• Provide accurate and current information
• Keep your login credentials secure
• Accept full responsibility for all activity under your account

We reserve the right to terminate accounts for breach of these terms.

4. Payment and Subscriptions

Certain Services may require payment via monthly or annual subscriptions. By purchasing, you agree to:

• Provide accurate billing info
• Authorize automatic recurring charges (where applicable)
• Cancel in writing before your next billing cycle to avoid charges

Payments are non-refundable unless explicitly stated in writing. All billing is processed via Stripe, and subject to its terms.

5. License and Restrictions

You are granted a limited, non-exclusive, non-transferable license to access and use the Services for business use only.

You may not:

• Reverse engineer or decompile our software
• Use our Services for illegal or unauthorized purposes
• Resell, sublicense, or clone any part of the platform
• Use the system to send spam or harmful content

6. Data & Privacy

Use of the Services is governed by our [Privacy Policy]. By using our platform, you consent to our collection and use of your data as outlined there.

You are responsible for all customer data you enter into the system and must ensure your own compliance with privacy laws (e.g., GDPR, CCPA) as they apply to your business.

7. Disclaimers

The Services are provided “as is” and “as available” without warranties of any kind. We do not guarantee uptime, performance, or that estimates produced by Fencetimator will be error-free or accepted by your clients.

8. Limitation of Liability

To the maximum extent permitted by law, LeadLegend Ltd and its affiliates shall not be liable for any indirect, incidental, consequential, or punitive damages, including loss of profits, arising from your use of Fencetimator.

Our liability is limited to the amount you paid for the Services in the 3 months prior to the claim.

9. Intellectual Property

All content, software, branding, and features within the Services are owned by LeadLegend Ltd and protected by applicable copyright and trademark laws.

You may not copy, modify, or use our IP without written permission.

10. Termination

We reserve the right to terminate your account and access to the Services at any time, with or without cause. You may cancel at any time by emailing support@leadlegend.freshdesk.com.

Any unpaid amounts remain due upon termination.

11. Refunds

Unless explicitly stated otherwise:

• Subscription fees are non-refundable
• Setup or onboarding fees are non-refundable
• You may cancel your subscription at any time to avoid future charges

We may, at our sole discretion, offer a refund if you have not used the system during the active billing period and request cancellation within 14 days of payment.

12. Dispute Resolution

This agreement shall be governed by the laws of England and Wales. In case of dispute:

• Parties agree to resolve via binding arbitration in London
• Class actions are waived; all disputes will be resolved individually

13. Changes to These Terms

We may update these Terms from time to time. Continued use of the Services constitutes your acceptance of the new Terms. Changes will be posted to this page with an updated date.
